These Terms of Service (the “Terms”) set out the conditions for using the BanteNote app for iPhone and iPad and the related website and server features (together, the “Service”) provided by Takeshi Yamamoto (the “Operator”). By using the Service, you agree to these Terms.
Article 1 (Application)
- These Terms apply to all relationships between the Operator and users concerning the use of the Service.
- Explanations and notices that the Operator shows in the Service or on the website form part of these Terms.
- In addition to these Terms, Apple’s Licensed Application End User License Agreement applies to the license to use the app.
Article 2 (The Service)
The Service organizes and shows the distance of each club and similar information, based on your golf practice records. Its main features are:
- Practice records (by photo, by entering numbers, or as results against a target), the Bag Map, and drills
- Photo analysis (reading numbers from a photo of a launch monitor or simulator screen)
- AI insight (AI explaining tendencies in your shots from the numbers you recorded)
- Paid plan features (detailed club analysis, drill SIM analysis, a longer Bag Map period, cloud backup, a larger allowance and more)
Article 3 (Accounts)
- You can use the Service without creating an account (as a “guest”). Some features, such as cloud backup, require you to sign in.
- You are responsible for keeping your sign-in information safe. The Operator is not liable for damage caused by inadequate management on your part beyond the scope of Article 12.
- You can delete your account at any time from “Account deletion” in the app.
Article 4 (Minors)
Minors must obtain a parent’s or guardian’s consent before using the Service, including buying a paid plan.
Article 5 (Paid plans)
- The paid plans (Pro and Pro+) are auto-renewing subscriptions bought through in-app purchase on the App Store. Prices and periods are shown on the purchase screen and on the pricing page.
- Payment is charged to your Apple account when you confirm the purchase. The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period.
- You can cancel or change your plan in the App Store’s subscription settings. After cancelling, you can use the paid features until the end of the current period. Deleting your account does not cancel your subscription.
- Refunds follow Apple’s procedures. The Operator does not give prorated refunds for cancelling during a period.
- When a paid plan ends, its features are no longer available. Records on your device are not deleted. Cloud backups are deleted 30 days after the paid plan ends.
- The Operator may change the prices or content of the paid plans. Price changes are announced in advance through the App Store’s procedures.
Article 6 (Allowance)
- Each photo analysis and each AI insight uses one unit of your allowance. The allowance is 5 per 30 days on the free plan, 250 per month on Pro, and 600 per month on Pro+.
- Unused allowance does not carry over to the next period.
- Once a photo analysis has started, the allowance is not returned even if the analysis does not succeed. If an AI insight cannot return an answer, the allowance is returned.
- The allowance cannot be transferred to others or exchanged for money, and is not refundable.
- To keep the Service stable, the Operator may set a daily limit or temporarily stop accepting requests when the Service is busy.
Article 7 (Photo analysis and AI insight)
- Photo analysis and AI insight work by sending photos or numbers through the Operator’s server to an external AI service, only if you agree. What is sent and how it is handled is described in the Privacy Policy.
- Photo analysis results and AI insights are for reference only. The Operator does not guarantee that they are accurate, complete or fit for your purpose. An AI insight is an estimate from your recorded numbers; it has not seen your swing.
- The Service is not a measuring device. It does not give instruction on how to move your body or advice about injuries or pain.
Article 8 (Cloud backup)
- Cloud backup is available on a paid plan while you are signed in.
- Only the latest backup is kept. Photos are included newest first, up to 1 GB on Pro and 2 GB on Pro+. Backups and restores are limited in number.
- Restoring replaces the records, photos and settings on your device with the contents of the backup, and cannot be undone.
- The Operator does not guarantee that a backup can always be created or restored. We recommend keeping your own copy of important records.
Article 9 (Your records and photos)
- The rights to the records you make and your photos belong to you.
- The Operator handles your records and photos only as needed to provide and operate the Service and to investigate problems. They are never used to train AI.
- You may import into the Service only photos that you own or are permitted to use.
Article 10 (Prohibited conduct)
You must not:
- Act against laws, public order or good morals
- Infringe the rights of the Operator or third parties (such as copyright or privacy)
- Put excessive load on the Service’s servers or network, or send large numbers of requests by automated means
- Obtain allowance or bonuses improperly (for example, by creating many accounts or altering purchase status by improper means)
- Access the Service without authorization or circumvent its security mechanisms
- Disassemble, decompile or reverse engineer the app, except as permitted by law
- Impersonate another person through the Service
- Do anything else the Operator considers inappropriate
Article 11 (Changes, suspension and termination of the Service)
- The Operator may change the Service, add new features or discontinue features.
- The Operator may temporarily suspend all or part of the Service without notice in the following cases:
- Maintenance, inspection or updates of equipment
- Power outages, disasters, or failures of communication lines or external services (such as AI services or cloud services)
- Other cases the Operator considers necessary
- The Operator may end the Service after giving advance notice.
Article 12 (Disclaimer and limitation of liability)
- The Operator does not warrant that the Service is free of factual or legal defects (including accuracy, security and fitness for a particular purpose).
- The Operator is not liable for damage arising to you in connection with the use of the Service, except where caused by the Operator’s intent or gross negligence.
- Notwithstanding the preceding paragraph, if you suffer damage due to the Operator’s negligence (excluding gross negligence), the Operator’s liability is limited to damage that would ordinarily arise, up to the amount you paid for the Service in the 12 months before the month in which the damage occurred.
- Where the Consumer Contract Act or other laws prevent the preceding two paragraphs from applying, those laws apply.
Article 13 (Suspension of use)
If you violate these Terms, the Operator may suspend your use of the Service or delete your account without prior notice.
Article 14 (Changes to these Terms)
- The Operator may change these Terms in accordance with the provisions of Japan’s Civil Code on changes to standard terms.
- When these Terms change, the new content and the date it takes effect will be announced on this page before that date. Changes that are unfavorable to users will also be announced in the app or in our news.
Article 15 (Notices)
The Operator gives notices to users by showing them in the Service, by posting them on this website, or by sending them to the email address you registered.
Article 16 (Governing law and jurisdiction)
- These Terms are governed by the laws of Japan.
- The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute concerning the Service.
Supplementary provision: These Terms apply from October 25, 2026.
